Aligning Your Will with Your Post-Divorce Reality

A divorce decree addresses property division and parenting arrangements, but it doesn’t replace your will. Without a separate review, your will could still name an ex-spouse as a beneficiary, leave out stepchildren you now want to include, or assign executor responsibilities to someone you no longer trust. We review your divorce decree, custody order, and any marital agreements before drafting an amendment so your estate plan and your family court orders are aligned rather than at cross-purposes.

Oklahoma Law on Amending a Will

Under Title 84 of the Oklahoma Statutes, a will may be amended at any time through a codicil, which must be executed with the same formalities as the original will. The document must be in writing, signed by the testator, and witnessed by two competent witnesses. The testator must also have testamentary capacity, meaning they understand the nature of the act, the extent of their property, and who their natural heirs are.

Oklahoma provides two general paths for changing a will. A codicil works well for narrow or minor changes. More extensive revisions often call for an entirely new will that formally revokes the prior one, since multiple codicils to the same document can create contradictions and increase the risk of disputes during probate.

Life Events That Call for a Will Amendment

Certain family changes make a will review important. Under Oklahoma law, if a testator divorces or has a marriage annulled after executing a will, certain provisions in favor of the ex-spouse are automatically revoked. That statutory protection is meaningful, but it doesn’t update every provision affected by the divorce, and it doesn’t add anyone new.

Other situations that commonly prompt Oklahoma City residents to amend their wills include:

Remarriage or blended family formation: Stepchildren and a new spouse may need to be added, and prior beneficiary designations may need adjustment
Birth or adoption of a child: A new child may not be covered under an existing will and could otherwise be subject to intestacy rules

Significant asset changes: Acquiring or selling a business, real estate, or other major property can make prior distribution language inaccurate

Common Will Amendment Mistakes to Avoid

Execution errors are among the most damaging problems with codicils. Failing to properly date the amendment, omitting a reference to the original will, or not including witness signatures in the correct format can render the codicil invalid. A defective codicil may be disregarded entirely during probate, leaving the original will in effect.

Storage and communication matter just as much as drafting. A codicil should be kept with the original will, and your executor should know where both documents are located. If a probate court can’t locate a codicil, it may proceed under the original will as though the amendment never existed.

Vague or ambiguous language creates a third category of risk. Unclear beneficiary descriptions, imprecise asset references, and contradictory instructions all increase the likelihood of disputes among heirs. Precise drafting at the amendment stage can reduce that kind of friction later.
